RAIPUR: The Chhattisgarh high court has said that society needs to “change dialogue at home” to erase discrimination based on skin colour, and criticised the fairness cream industry for portraying dark-skinned women as under-confident and insecure.
The bench of Justice Goutam Bhaduri and Justice Deepak Kumar Tiwari was hearing a matrimonial dispute when it made the observations.
The court took note of the abuses the husband hurled at his wife for being dark-skinned and called upon society to change this mindset. The judges noted that “incentive cannot be given to a husband to promote society’s preference for light skin over dark”.
The court observed that dark-skinned women are often depicted as insecure until they use a fairness cream, which, in the court’s perspective, necessitates a change in the way such topics are discussed at home.
In the case at hand, the husband had sought divorce, alleging desertion by his wife. The wife countered with claims of torture, physical assault during pregnancy, and emotional abuse related to her dark skin colour. The court dismissed the husband’s appeal after evaluating evidence presented by both parties.

After considering the case, the court found the wife’s allegations more compelling and dismissed the husband’s application for divorce.
The high court strongly asserted that no individual should be granted the liberty to abandon their legally wedded spouse solely based on skin colour, and highlighted the importance of eliminating such biases from matrimonial decisions.
